The Tax Authority’s strong shift towards an automated, technology-driven compliance monitoring model, coupled with stricter management of e-commerce tax and e-invoices, requires businesses to proactively review their operating systems to prevent risks of tax arrears and severe penalties.

KEY DISCUSSION TOPICS:
- Risk and Compliance Management (Circular 94/2026/TT-BTC): The tax authority applies AI to automatically rank compliance (4 levels) and risk (3 levels). We will highlight the risk of automatic invoice locking or pre-refund tax audits if the system detects abnormal signs. Conversely, maintaining a “Good Compliance” status will bring privileges such as fast-track tax refunds and reduced tax inspections.
- E-invoices and E-documents (Decree 254/2026/ND-CP & Circular 91/2026/TT-BTC): New regulations on exemption from issuing invoices when receiving pure service deposits; and detailed procedures for correcting invoices with incorrect names/addresses. However, businesses face a high risk of sudden inspections and heavy penalties due to a reward mechanism of up to 10 million VND for consumers who report businesses failing to issue invoices via the eTax Mobile app.
- Tax Registration & E-commerce (Circular 90/2026/TT-BTC): Reduced administrative procedures when relocating headquarters to another province (removing the requirement to fulfill tax obligations at the original location before changing address). A critical risk hotspot: E-commerce platform operators face significant tax arrears if they fail to promptly update their systems to withhold, declare, and pay taxes on behalf of foreign suppliers.
- PIT Obligations for Employers: Updates on compliance controls and the obligations of businesses regarding the withholding, declaring, and paying of Personal Income Tax (PIT) on behalf of employees under the new law to avoid administrative penalties.
